Once storage fees exceed the cost of merchandise, Auction STORM will take merchandise for payment of storage.

Auction STORM Terms and Conditions Auction STORM Online Terms and Conditions Participation in any and all online auction bidding and purchases requires becoming a registered bidder with the Auction STORM. As a registered and active bidder you are bound by these Terms and Conditions outlined in this document, posted on website(s), emails and in any and all online and live auctions. Full Name and Address Required Prior to any participation in any live, online or posted auctions hosted by the Auction STORM you must complete registration online or in person. All bidders must provide their full legal name, address, daytime and/or evening phone number and email address. The Auction STORM reserves the right to deny registration without disclosing cause. Deposit May be Required In the event The Auction STORM hosts “special” or “elite” online or live auction(s), a credit card may be asked to be added to your registration, should one not be supplied the Auction STORM will require a cash deposit to secure any high bids that may be placed. Purchase by Highest Bidder VERSES Purchase by Proxy or Consignor's Reserve The Auction STORM determines the ownership of items by the highest bid placed by valid registered bidders. The valid registered bidder(s) could be present, online or by proxy vote. Any Consignor placing an item in an Auction STORM auction, live or online, does have the option to leave a reserve. In the event a reserve has been left by a Consignor, the auctioneer will serve as bidder to represent and honor set reserve. Any disputes, including but not limited to, price, item or ownership will be resolved by Auction STORM by implementing a review of surveillance, validated information and or any other means deemed suitable to satisfy said disputes or concerns. All items in the auction will be sold to the highest bidder unless the Consignor has a minimum reserve price. In this case the bid price is subject to the Consignor's confirmation. In some cases, the auctioneer may bid on behalf of the Consignor to protect the reserve. Disputes over the winning bid price or any other problem will be settled according to records kept by Auction STORM. Buyers Premium and Bidding All successful bids are subject to stated Buyer's Premiums, whether it is an Online or House Buyer's Premium and are subject to change. Percentage of premium is determined as to how items where won online or in-house. All purchases are subject to any and all applicable sales tax. Registered buyers that are deemed as Tax Exempt are required to provide a copy of their state exemption certificate to have taxes vacated on final purchase invoices. Upon submitting a bid, whether it is at a live auction or online with the Auction STORM you are entering into a legal and binding contract and with each successful bid you assume responsibilities for payment as well as removal of the item(s) purchased. Additionally, all items must be removed within the standard time, close of business following day. Any items still in the possession of the Auction STORM after close of business following day are subject to storage fees and/or forfeiture. In the event that you, by any means, increased your own bid it is your responsibility to contact the Auction STORM via email or website within 5 minutes of mistake, otherwise we will not reverse the bid and you will be responsible for the bid amount should you win the auction. We will not reverse bids after this time - no exceptions. Shipping In the event the successful bidder requires having their item(s) shipped those costs and fees will be the responsibility of that successful bidder. Auction STORM utilizes 3rd party shippers and any and all shipping costs and fees will be invoiced separately from the actual auction purchase of said item(s). Payment The Auction STORM accepts cash and credit cards as payment. Upon completion of each online Auction STORM auction those purchases made by registered bidders with credit cards on file will be charged immediately after auction. A printed invoice must be provided to release those items. In the event your credit card is unable to be processed for payment, cash payment is required within 24 hours of completed auction. Items not paid for by close of business the following day will be forfeited and bidder will be restricted from participating in any future auctions until outstanding balance has been paid. For credit cards that result in a declined transaction, a $5.00 processing fee will be charged to re-establish the credit card. Bidder Inspection and "As Is, Where Is" Condition Auction STORM provides scheduled viewing and testing times for any and all items offered in its online and live auctions. It is the responsibility of all potential buyers to examine and inspect items of interest prior to bidding and purchase. In all cases and in all items offered in Auction STORM auctions items are sold AS IS, WHERE IS and NO GUARANTEES EXPRESSED OR IMPLIED. Any Consignor and Auction STORM expressly disclaim any warranty concerning the condition, quality, nature, fitness for particular purpose, value, or merchantability of any and all item(s). No allowance will be made for errors in cataloging, defects, imperfections not noted or the genuineness of items. Auction STORM provides photographs online for bidder’s convenience and are not to be interpreted to create representations or warranties of any item. Auction STORM relies on the consignor to provide any information concerning all items and Auction STORM makes no investigation or warranty regarding the accuracy of the provided information. All descriptions are for general opinion ONLY. It is the bidder’s responsibility to inspect research and determine their own opinion of each item PRIOR to bidding or purchasing, there are NO REFUNDS. Removal & High Bidder's Responsibilities for Estate Liquidations Off-Site Items purchased at an offsite location will become the responsibility of the successful bidder at the conclusion of that auction. Responsibilities include any and all expense in removal, liability, and risk, to include disconnection of utilities if applicable. Upon the conclusion of the offsite auction, any items not secured will be considered abandoned by the successful bidder and additional fees and damages will be assessed and charged. These fees to include, and are not limited to: any and all damages resulting from non compliance such as cost of final bid, storage fees, labor fees, filing fees and if applicable, attorney’s fees. Auction STORM reserves and administers the right to dispose of any and all item(s) at their discretion. This includes items paid for by the successful bidder but not removed. Successful bidder forfeits item(s) and becomes the property of Auction STORM regardless if paid for should they not be removed within stated timeframe. It is the responsibility of the successful bidder or their appointed agent to confirm any and all items are accounted for as any and all discrepancies must be resolved prior to leaving offsite property. NO REFUNDS WILL BE GIVEN. Refund(s) & Non Pick Up for Estate Liquidations Off-Site No refund(s) will be allowed after an item has been removed from the auction site. If payment has been made and item is unavailable for pick up during specified times the high bidder shall receive a refund for the sum paid. This guarantee of refund shall be invalid if high bidder fails to remove item before the last day of announced pickup/removal times. In no event shall Auction STORM be liable to any bidder for any act or omission occurring in connection with the auction for an amount that exceeds the amount that such bidder has actually paid to Auction STORM, as a deposit or as payment for a purchased item. Types of auctions: Web Cast Auction Auctions are conducted with pre-bidding online, live online bidding and live in house bidding during ending times. Online Only Auction with Dynamic Closing The closing time of an item(s) or lot(s) are automatically extended an additional amount of time whenever a bid is placed within the last minutes of the item(s) or lot(s) closing time. This type of auction will be identified within the description of auction. Online Pre-Bid or Proxy-Bids Auctions of this nature will close for Online Buyers at a specific time and open for live in person bidding activity. The Online Pre-Bid or Proxy-Bids will start the bidding for live in person bidders, Auction STORM will bid on behalf of the Online Bidder. This type of auction will be identified within the description of auction. Item Offerings and Removals At the discretion of Auction STORM, item(s) may be offered by the piece or by the lot in addition to intersperse with items from various other Consignor. Consignors, with the consent of Auction STORM reserves the right to remove item(s) before or after bidding from the auction. In the event removal is administered after bidding is completed, the high bidder’s sole remedy shall be the actual PAID AMOUNT refunded. Auction Participation & Compliance with Terms Participation in an Auction STORM auction, Bidders represent, irrefutably warrant and covenant: - Have the ability to conclude transaction pursuant to the Terms & Conditions - Have the ability to provide payment including any and all additional fees as presented - Have the legal authority to enter into an agreement to purchase item(s) - Acknowledge non-compliance with stated Terms & Conditions will result in forfeiture of item(s) won, and possible additional fees - Acknowledge that by placing a bid they enter into compliance with these Terms & Conditions Acknowledgment of Dangerous Auction Site Potential bidders when inspecting and high bidders/purchasers or their agents acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises. High bidders will so advise their agents and employees. This acknowledged risk extends into all activities involved in the removal of items including disconnection of utilities. Persons attending the auction site during preview, sale, or removal assume all risks of injury damage or loss of property and specifically release Auction STORM and the Consignor from liability. Auction STORM as Agent Only Auction STORM is acting only as an agent and is not responsible for the action of the principals. Item Removal from Auction Site Auction STORM will announce the removal or "check-out" period for each auction on that auctions online site. Online auctions will have the details posted on the auction event page. Auction STORM will assume no responsibility for any part of item removal. High bidders/purchasers will assume sole responsibility and risk for disassembling, disconnecting (including power and water and all utilities), loading, and removal of all purchased items. Purchasers will repair personal property that is altered or damaged in the removal of their items. Governmental Safety Environmental and Export Standards and Laws High bidder/purchaser agrees to comply with all applicable United States export laws and to acknowledge that Auction STORM is not the exporter. Auction STORM makes no representation into which, if any, items constitute "Restricted Technology" and as such cannot be shipped outside of the United States. In addition, it is the high bidders/purchasers or their agents' responsibility to meet all government safety and environmental laws/standards when removing and shipping purchased items. Auction STORM has no duty to remove hazardous substances contained in any item. Identification and removal are the sole responsibility of the purchaser/ high bidder. Malfunction, Shutdown, Loss of Service The results of the auction may be rendered void if a malfunction, shutdown, or temporary loss of service occurs. In such an event, Auction STORM reserves the right to remedy the situation in whichever way best represents the Consignor, including the cancellation of existing bids. Auction STORM shall not be held liable in any way for any malfunctions, shutdowns, or loss of service. Auction Closing and Payment and Pickup Each auction has its own ending time listed on that auction's site and in advertisements. Auctions end automatically at this time unless an automatic extension is in effect. Notification/invoices will be sent to winning bidders. In the event that you have not received your notification/invoice by the afternoon of the day following the closing of the auction, please contact Auction STORM at 602-272-3222. High bidders/purchasers are expected to make arrangements for removal and conform to the pickup days allotted. Methods of payment include: Cash, Credit Card or Debit Cards. All payments not paid in cash within one day of auction will automatically charge to credit card on file. Indemnification & Acceptance of Auction Terms by Bidders Purchaser and Bidders agree to indemnify and hold harmless both the Consignor and Auction STORM from and against all claims and liabilities resulting from online auction, including but not limited to: Proximate or consequential damages, failure to comply with local, state, or federal laws, and cost of legal expenses arising there from. No person shall have any claim against Auction STORM, their respective agents or employees for any injuries sustained or damages to or loss of property that may occur at the auction site. These Terms and Conditions, and all questions with respect to the interpretation of these conditions shall be governed by and construed in accordance with the internal laws of the State of Arizona, without regard to conflict of law’s provisions. All bidders expressly consent to personal and exclusive jurisdiction in the courts of the State of Arizona. In bidding, you consent to agreeing with all the Terms and Conditions stated above and any auction specific terms posted on each auctions event page and/or terms emailed to you and or terms posted on www.theauctionstorm.com. By submitting this form you acknowledge all that is stated in the Auction STORM Terms and Conditions.
